“The Commissioner never uses the General Anti-Avoidance Rule in Part IVA on small businesses…” or does he? Recent cases suggest otherwise. Over the past year, the Commissioner has actively applied Part IVA in various scenarios involving small to medium enterprises (SMEs), including:

  • Minerva Case: Applying Part IVA where a trustee makes a low-taxed beneficiary presently entitled to the income of a trust, rather than a high-taxed beneficiary.
  • Merchant Case: Successfully applying Part IVA to a wash transaction where the taxpayer sold loss shares to their SMSF to reduce the capital gains tax on other shares they had sold.
  • Michael John Hayes Case: Applying Part IVA to dividends paid to newly formed trusts with dividend access shares issued to them.
  • Guardian Case: Forming a “reasonable alternative postulate” to determine if there was a tax benefit, ignoring the tax outcome of the alternative postulate, even if it would have caused a prohibitive amount of tax.

Ken Mansell

Ken currently works in a part-time capacity for both the Australian and Solomon Island government on tax policy and provides tax and super education for a series of organisations. He has previously worked on the secretariat of the Henry Review and in the office of the Assistant Treasurer as a tax advisor. Ken has also worked in the tax division for both KPMG and Deloitte, as a tax trainer and tax specialist for the Institute of Chartered Accountants in Australia and as the head of taxation for the Seven Network Limited group and Raytheon Australia. Further, he has worked as a legal researcher in both commercial and academic role.
