For individuals and small businesses, the use of trusts is widespread for a range of reasons. They can be exceptionally advantageous if used correctly, however, they can be complex in their design and burdensome in their obligations. It has long been said that a business structure can only be successful if the key personnel understand it – although unfortunately due to the complexity of trusts in Australia, it could be said that many trust controllers do not truly understand the nuances of the a trust.

Trust losses and key CGT events impacting trusts

The third webinar in this instructive series is specifically focused on the landscape of trust loss rules. In general, trusts retain revenue and capital losses but may be carried forward utilised in future income years – provided the trust loss rules are satisfied. These rules require different categories of trusts to satisfy one or more tests to claim a deduction for carried forward revenue losses. The first part of this webinar will explain the different trust loss rules, when they may apply and how they can be satisfied to make sure that a trust does not inadvertently forfeit future use of tax losses. It will also cover the impact of family trust elections on the trust loss rules.

The second segment of the webinar shifts its focus to the realm of Capital Gains Tax (CGT) events as they pertain to trusts. The emphasis will be placed on those CGT events that practitioners are most likely to encounter in everyday scenarios. This section aims to provide a robust, practical understanding of how these events impact trust structures, thereby equipping attendees with the requisite knowledge to proficiently navigate these complexities within Australian tax law.
